What Is Personal Data?

Personal data is any information relating to an identifiable living person. This may include your name, contact details and information we collect during the course of providing legal services.

It may also include “special category” data such as information about racial or ethnic origin, religious or political beliefs, health data, trade union membership, genetic or biometric data, or sexual orientation. Information relating to criminal convictions and offences is also subject to strict controls.

We only process personal data where necessary and for specific lawful purposes.

How We Collect Personal Data

We primarily collect personal data directly from you. In some circumstances, we may receive information from third parties such as clients, courts, legal professionals or other organisations where relevant to a legal matter.

Where a client provides us with personal data about another individual, we require that they have the appropriate lawful basis for doing so.

Contacting You

We will only send marketing communications to individuals where consent has been provided. If you represent an organisation, we may contact you unless you request otherwise.

All marketing emails contain an option to unsubscribe.

If we are required by law or contract to collect personal data and you fail to provide it, we may be unable to provide services.

Who We Share Data With

We may share your data with:

  • IT providers to maintain secure and up-to-date systems;
  • Financial and quality auditors for regulatory compliance;
  • Other legal professionals and technical experts where required;
  • Records management providers for secure document destruction.

How We Store and Retain Data

Personal data is stored in both hard copy and electronic formats. Electronic data is stored on secure UK-based servers. Some cloud-based service providers store data within the European Union and are accredited to ISO 27001 standards.

We rarely transfer data outside the UK or EU. Where this occurs, appropriate safeguards will be implemented.

We retain data in accordance with statutory requirements, limitation periods and best practice retention schedules. When retention periods expire, data is securely destroyed.

Your Rights

You have the right to:

  • Be informed about how your data is used;
  • Access your personal data;
  • Correct inaccurate data;
  • Request erasure in certain circumstances;
  • Object to marketing or certain other processing;
  • Restrict processing in limited situations;
  • Receive certain data in portable electronic format;
  • Challenge automated decision-making where applicable.

Where processing is based on consent, you may withdraw that consent at any time.

If you have any questions about this policy or wish to exercise your rights, please contact our Data Protection Coordinator at info@rc.legal or on 01625 43 11 11.
